Legal framework
Swiss law defines racial discrimination as any form of unjustified inequality of treatment, verbal statement or physical use of force that discriminates against a person or a group of persons on the grounds of their ethnic origin, race, language or religion. The prohibition of discrimination is enshrined in the following legal bases in particular:
- Constitutional prohibition of discrimination / Art. 8 / Federal Constitution (Cst.)
- Protection of legal personality under civil law / Art. 27 and 28 / Swiss Civil Code (CC)
- Statutory provision on racism / Art. 261bis / Swiss Criminal Code (SCC)
